Deliveryman Slips on Dog Pooh - Sued

A three-judge panel of the Michigan Court of Appeals has plunged itself into a delicate issue - who is responsible for the dangers of dog doo?

The delivery man, who lives in Genesee County, sued, alleging the homeowners did not maintain their house and failed to warn him of the doggy land mines. He's seeking damages for injuries, but the extent of his injuries is unknown. But the appeals court ruled an employer may have a responsibility to train delivery employees to avoid slipping on the stuff.

"(The company's) alleged failure to train plaintiff may have contributed to plaintiff's injury ... because plaintiff may not have been sufficiently aware that pet feces is a potential hazard," the court wrote.
